Statement in Support of House Bill 401

DHAA urges Delaware representatives to support House Bill 401 and establish reasonable protections for hemp consumers, small businesses, and employees.

Now that House Bill 395 has advanced, House Bill 401 is even more important. Delaware needs a clear, balanced path forward that protects consumers and allows compliant hemp businesses to continue operating.

Delaware hemp consumers, retailers, employees, and small business owners deserve certainty, not disruption. House Bill 401 provides a responsible interim framework that supports public safety while preserving access to hemp wellness products for adults over the age of 21.

House Bill 401 focuses on the protections Delaware consumers need now, including age verification, product testing, labeling, enforcement, and responsible retail standards. These are practical safeguards that can address concerns in the marketplace without forcing compliant small businesses to close.

DHAA agrees that Delaware should address bad actors and stores that fail to age-gate appropriately. However, those concerns should be handled through clear rules, licensing, enforcement, and accountability rather than uncertainty that threatens an entire industry.

Between now and the upcoming federal changes surrounding hemp, Delaware needs House Bill 401 to create a fair regulatory structure that protects consumers, supports small businesses, preserves jobs, and allows the state to generate tax revenue from products adults are already purchasing.

House Bill 401 works alongside House Bill 395 by serving as a common-sense placeholder and regulatory bridge before broader federal changes take effect. It gives Delaware the opportunity to put proper protections in place while allowing responsible businesses to remain open and compliant.

DHAA urges Delaware representatives to vote YES on House Bill 401. Delaware should protect consumers, preserve small businesses, support employees, and create a reasonable regulatory path forward before House Bill 395 is implemented.

DHAA remains committed to working with lawmakers, regulators, stakeholders, consumers, and business owners to support responsible hemp policy that protects Delawareans and keeps compliant businesses operating.

Why Now

Stats list:

  • 13 states have outlawed delta-8 THC specifically. MPP
  • 32 states have enacted some form of regulation around intoxicating hemp products. KCUR
  • Delaware’s rules conform to 0.3% delta-9 THC post-decarboxylation on a dry weight basis.
  • Delaware DOJ is already enforcing monopoly-style rules, treating THCa as marijuana regardless of federal protections.
The risk: If we don’t act, Delaware hemp businesses will be shut out in favor of dispensary monopolies.
The opportunity: With unity, we can push for a safe, transparent, and open-market framework that protects both consumers and small businesses.
